IMPORTANT: Please read this End User License Agreement ("EULA") carefully before downloading, installing, or using any MyAgencyApps application. By installing or using the app, you agree to be bound by the terms of this EULA.
MyAgencyApps ("Licensor") grants you a limited, non-exclusive, non-transferable, revocable license to download, install and use the application (CleanCo, PlumberCo, ElectricianCo, or any other MyAgencyApps application) on any Apple iOS device that you own or control, subject to the terms of this EULA and the App Store Terms of Service. Business License: Registered Business Users receive a license to generate and share Business Codes with their clients and staff. This license permits the Business User to operate a branded booking and application portal through the MyAgencyApps platform. End User License: Clients and cleaners who access the platform via a Business Code receive a limited license to use the application features enabled by that Business User. This license is contingent on possession of a valid Business Code and may be revoked if the Business User's account is terminated. This license does not allow you to use the application on any device that you do not own or control, and you may not distribute or make the application available over a network where it could be used by multiple devices at the same time.
You may not: • Copy, modify, or distribute the application or any content from it • Reverse engineer, decompile, or disassemble the application • Rent, lease, lend, sell, redistribute or sublicense the application • Remove or alter any proprietary notices or labels on the application • Use the application for any unlawful, harmful, or fraudulent purpose • Attempt to gain unauthorised access to any servers or networks • Use automated tools to access or scrape data from the application
The following terms apply to any application accessed through or purchased from the Apple App Store: a) This EULA is concluded between you and MyAgencyApps only, not with Apple Inc. ("Apple"). Apple is not responsible for the application and its content. b) MyAgencyApps, not Apple, is solely responsible for the application and its content. c) Apple has no obligation to furnish maintenance or support services for the application. d) In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application (if applicable). Apple has no other warranty obligation with respect to the application. e) Apple is not responsible for addressing any claims by you or any third party relating to the application. f) Apple is a third-party beneficiary of this EULA and will have the right to enforce this EULA against you.
The application and all copies thereof are proprietary to MyAgencyApps and title thereto remains in MyAgencyApps. All rights in the application not specifically granted in this EULA are reserved to MyAgencyApps. You acknowledge that no title to the intellectual property in the application is transferred to you. The application is licensed, not sold. All trademarks, service marks, trade names, and logos displayed in the application are the property of their respective owners.
Our Privacy Policy, available at myagencyapps.com/privacy, is incorporated into this EULA by reference. By using the application, you consent to the collection and use of your data as described in our Privacy Policy. The application may collect and use: • Personal information you provide (name, email, phone, address) • Device information and usage data • Location data (with your permission) • Photos and documents you choose to upload
The application may integrate with or link to third-party services including: • Apple Pay for payment processing • Google Maps for navigation • WhatsApp for messaging • Twilio for SMS notifications • Stripe for payment processing These third-party services are governed by their own terms of service and privacy policies. MyAgencyApps is not responsible for the practices of these third parties.
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYAGENCYAPPS DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MYAGENCYAPPS DOES NOT WARRANT THAT: • The application will meet your requirements • The application will be uninterrupted or error-free • Defects will be corrected • The application is free of viruses or other harmful components
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYAGENCYAPPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. IN NO EVENT WILL MYAGENCYAPPS'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination: • All rights granted to you under this EULA will cease • You must cease all use of the application • You must delete all copies of the application from your devices Termination will not limit any of MyAgencyApps's rights or remedies at law or in equity.
MyAgencyApps may from time to time develop patches, bug fixes, updates, upgrades and other modifications to improve the application ("Updates"). These may be automatically installed without providing notice to you or obtaining your consent. We reserve the right to modify this EULA at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use constitutes acceptance.
This EULA shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising under this EULA shall be subject to the exclusive jurisdiction of the courts located in Australia.
As a registered Business User, you accept the following responsibilities: • You are responsible for all activity on your Business Code, including all bookings and applications made by clients and cleaners using your code • Only share your Business Code with authorised clients and staff who are permitted to access your portal • Do not share your Business Code publicly or on social media platforms • Report lost or compromised codes to hello@myagencyapps.com immediately so a replacement code can be issued • You are responsible for ensuring that clients and cleaners you invite comply with these terms • MyAgencyApps reserves the right to suspend a Business Code if it is found to be misused or shared in violation of these terms
